Washington has passed legislation providing consumer protection with regard to gift cards. Expiration dates are not allowed unless the card was issued as part of a customer rewards plan or donated to charitable organization. If there is an expiration date, it must be clearly disclosed on the gift card or certificate. A monthly inactivity fee of a maximum of $1.00 is allowed if the balance is under $5.00 and the card is reloadable and has been inactive for 2 years or more. Gift cards in Washington can be redeemed for cash if the value is less than $5.00. Cards with an expiration date may escheat to the state after 3 years of inactivity.
