Nebraska Consumer Protection Laws

Nebraska law has stated that any card with an expiration date will escheat to the state after 3 years of inactivity. The state offers no limits on expiration dates or post-sale fees. Fortunately the Federal CARD law provides consumers with some protection. Under the Federal law any expiration dates have a 5 year minimum and no after sale charges unless the card has not been used for more than one year.

Nebraska has less legislation relating to gift card user consumer protection than most states. We are encouraged by the Federal laws that have been passed and hope that Nebraska will work to improve their consumer protection laws.
