One sees almost as many advertisements for
personal injury lawyers as for
payday loan services. And, they certainly do make some wonderful claims.
While it is tempting to check your medicine cabinet for the latest drug that is on the attorneys’ current “black list”, or try to determine if it’s too late to seek medical treatment for that finger you pinched when you were trying to get two shopping carts apart, the truth is that these types of
personal injury lawsuits rarely have successful results.
What these types of lawsuits do, unfortunately, is clog civil courts with cases that should have never been filed, much less been allowed to have gotten as far as the inside of a courtroom, while preventing cases that have legitimate merit from being heard and families who are truly needing and deserving compensation from being helped.
This is not to say that no one should ever file a
personal injury lawsuit. There may indeed come a time when a loved one is injured, or their physical condition worsened, or a life is even lost through negligence, neglect, or medical error or malpractice. If this happens, then those who are left to care for the loved one who has been affected, or to support or aid those who were left behind as a result of a too-soon death have every right to file for damages and compensation.
Those who find themselves in this situation, however, should make sure that they have first made every attempt possible to allow those responsible to rectify the situation before making the drastic move toward
filing a lawsuit. Most companies, corporations, and/or organizations do want to do the right thing, and are willing to work with someone when there is a legitimate claim. If and when all avenues have been exhausted, then, and only then, should one turn to the justice system for satisfaction.
Once that decision has been made, those who are involved in the
lawsuit should not “rest on their laurels”; rather, they should make every effort to see that all documentation that they have been able to obtain or can get is retrieved and turned over to the attorney. While it is true that it is the lawyer’s job to get the case into court and presented, he or she can do a much better job if valuable time is not wasted in chasing down every scrap of paper that has any connection with the case.
The plaintiffs in the lawsuit will benefit from having assisted; also, as they can be sure that the lawyer indeed has everything he or she needs, and is as familiar with the case as can be.
Care should be taken in choosing the right lawyer. The ones who advertise on TV may be as competent as the one sitting in the high-rise in downtown Boston, but their outward appearance and slick advertisement should not be the only reasons he or she is chosen. Rather, the choice should be based on the lawyer’s experience and reputation among his or her fellow attorneys and the community in general.
Neither should a
lawyer be chosen because he or she was able to get the neighbor down the road a huge settlement. Each case is different, there are extenuating circumstances that may not have existed in another person’s case, and it simply may not be possible for the lawyer to achieve the same results for you as he or she did for the other person.
